Difference between a trademark registration and company registration



Incorporating a business in Hong Kong requires entrepreneurs and businessmen to decide on the name and trademark of the company first before moving on to the rest of the procedure. Unless these two conditions are satisfied, one cannot go to the other steps of Hong Kong company formation. Although the name and trademark of a single company are related, they are treated as individual entities.

 Here are some of the areas where trademark registration differs with company registration:

·         A trademark is a sign, logo, design, or mark that distinguishes the products and services of one producer from the other. A company registration requires the selection of a company name that will represent the entity for the rest of its lifetime, unless changed. 

·         There are different centers for registering trademarks and company name. A  HongKong Company Registry is responsible for providing registration services for local limited companies and companies incorporate outside Hong Kong. To registera trademark, the Trademark Registry is responsible for providing services.

·         The registration of company name or the business name isn’t the same as the trademark registry. Also, registering the company name doesn’t signify that the company can have the trademark registered. The businessperson is not allowed to use the trademark unless it has been approved by the registry. Similarly, having a trademark registered doesn’t give any authority to use the company name for any commercial operations. They can be used together if only they have been authorized by their respective boards.
