Factors to consider before applying for trademark registration

Having a trademark is like having a whole different identity under which you can carry out your business operations without being opposed by any private or public party. A trademark gives you the exclusive right to use it in relation to the goods and services registered under them. A suitable trademark also acts as a marketing tool and promotes your brand in many ways. It is, therefore, essential to find the right trademark for a successful business. 

But, before you go for the trademarkregistration, there are some points that require your attention. These are the factors you must consider before applying for the registration process. The advantage behind this action is it removes the hassles that might come in the future and lead to a faster registration of the company trademark.

·         Distinctness – Since it will be representing your brand, it has to be distinct and new in every respect. The graphical design mustn’t match any other logo that already exists. Be it a character, logo, word, etc., it should be distinct.

·         In relation to the goods and services – The logo must speak about the products and services that are going to be sold under them. However, it shouldn’t describe their quality, quantity, value, or purpose.

·         Shouldn’t represent any well-known term – The trademark that you are going to select shouldn’t represent any well-known term or product line that already appears in the business industry. For instance, V6 stands for Vehicle engines and it should never appear in any trademark.

·         Trademarks search – It will be helpful if you conduct a search for your trademark on the Hong Kong Trade Marks Registry to see if it has been applied or taken by any other trader. For searching available company names, you can look in Hong Kong company registry.

Once you have gone through this process, you will find it highly easier to register a trademark.
